1. Seller Identification
These General Terms and Conditions of Sale are those of SASU FERME DU CHATEAU, a simplified joint-stock company with a share capital of €10,000, whose registered office is located at Impasse du Château – 76550 Ambrumesnil – France, registered with the Dieppe Trade and Companies Register under number 822 045 704. 2. Scope and Acceptance of the General Terms and Conditions of Sale
The purchase of products offered on the website www.embrin.fr is subject to these General Terms and Conditions of Sale.
The products offered on the website www.embrin.fr are exclusively intended for sale to end consumers, whether individuals or legal entities, to the exclusion of all resellers or intermediaries acting on behalf of resellers. Consequently, the customer declares that they are acting as an end consumer and do not intend to resell the products. FERME DU CHATEAU may update these General Terms and Conditions of Sale at any time. The General Terms and Conditions of Sale in force at the time the sales contract is concluded are those that apply to you. In addition, for each purchase on the Site, you will be asked to confirm your acceptance of the General Terms and Conditions of Sale in force at the date your order is placed.
3. Validity of Offers
Offers are only available to consumers with a delivery address in countries where FERME DU CHATEAU provides delivery via a transport provider. Products shown on the site are valid while stocks last. In the event of payment or collection for an order of an unavailable item, FERME DU CHATEAU undertakes to refund the Client within 15 days. FERME DU CHATEAU will notify by email any Client who has ordered an unavailable item. FERME DU CHATEAU reserves the right to cancel or refuse any order from a client with whom there is an existing dispute regarding payment for a previous order or who presents any kind of risk in its view.
4. Product Presentation
The products offered for sale are described and presented as accurately as possible. However, should any errors or omissions occur in this presentation, FERME DU CHATEAU cannot be held liable. The photos representing our products are for indicative purposes only. These photos, as well as the texts illustrating the products, are not contractually binding.
5. Prices
Product prices are indicated in Euros, Incl. VAT. The value added tax is that in force in France at the time of the Order. The prices shown on the website or online shop are final. They are guaranteed subject to typographical or printing errors. These prices do not include the flat-rate contribution to shipping and packaging costs, which remain the responsibility of the client, except in the case of a temporary or permanent promotional offer. Prices may be changed at any time, without notice, especially in the event of changes to fiscal or economic data. Items will be invoiced based on the rates in force at the time the order is registered.
6. Payment Terms
Products or services must be paid for in Euros (€). Any bank charges incurred by the payment, regardless of the method, will be borne by the Client. Delivered goods remain the property of FERME DU CHATEAU until payment is received. The transfer of risk takes place upon delivery of the goods. The only accepted method of payment is Bank Card (CARTE BLEUE / VISA / MASTER CARD).
7. Invoice
The invoice is sent to the email address provided at the time of ordering. It is issued in accordance with the rate in force on the day the order is placed. FERME DU CHATEAU accepts no responsibility for entry errors.
8. Delivery / Transport
Any item available in stock is dispatched within 1 to 3 working days. In all other cases, availability and dispatch date are specified on the product page. All these timeframes are indicative only. Exceeding these timeframes cannot be held against FERME DU CHATEAU, nor give rise to contract termination or any compensation for damages.
The choice of delivery method is at the discretion of FERME DU CHATEAU. Transport risks are borne by the Client from the moment the goods leave the warehouse. The client must check the condition of the packaging and the conformity of the items delivered and immediately notify FERME DU CHATEAU of any anomaly. Any reservations must be noted on the delivery slip presented by the carrier and sent within 48 hours by email to: [email protected]. If the delivery country is outside the European Union, customs duties will be payable by the recipient. FERME DU CHATEAU has no control over these charges, which are the sole responsibility of the Client.
9. Right of Withdrawal
The Client has a period of 14 days from the date of delivery of the goods to exercise the right of withdrawal from their order. The postmark or the date of the receipt of availability constitutes the start date of this period. Only returns of products in their original condition and properly protected will be accepted by FERME DU CHATEAU. The product must clearly not have been used in order to be accepted by FERME DU CHATEAU. Return costs are borne by the Client, unless FERME DU CHATEAU has delivered a product that is damaged or different from the item ordered.
It is recommended to return your parcels by “tracked colissimo with signature”; in the event of a dispute, you will be required to prove receipt of the parcel at our premises. All returns must be notified in advance to FERME DU CHATEAU Customer Service at [email protected]. Refunds are made within a maximum of 30 working days from receipt of the returned goods, by re-credit to the bank card used for the purchase or by cheque, after checking the condition of the item and its packaging. Beyond the 14-day period from delivery, goods will neither be taken back nor refunded. You do not have the right of withdrawal for the following items: made-to-measure items, items embroidered at your request to be personalised, curtains, armchairs, sofas, and gift cards.
10. Guarantee
Our products are made and checked with the utmost care and diligence, which allows us to guarantee them and undertake to refund any product considered defective. The Client has a period of 14 days from the date of delivery of the goods to report receipt of a defective product. If this is the case, FERME DU CHATEAU will refund the client for the product, as well as any shipping and return costs.
11. Obligations of the Parties
FERME DU CHATEAU, upon acceptance of an order, undertakes to sell and deliver to the Client the products ordered by the latter under the terms specified above. The Client undertakes to provide FERME DU CHATEAU with an address to which delivery can be made. The provision of personal information (name, address, telephone, email address, etc.) collected for the purpose of concluding the sales contract is mandatory.
This information is essential for processing and delivering orders and issuing invoices. Failure to provide this information will result in the order not being validated. In the event of an error in providing this information, FERME DU CHATEAU cannot be held responsible for the inability to deliver the product. In this case, the client remains responsible for payment. If an incomplete address is provided, resulting in the carrier being unable to deliver, the Client must pay the delivery costs for resending the order.
12. Personal Data
The collection of the Client's personal data is necessary for processing the order. This information is strictly confidential and intended solely for use by FERME DU CHATEAU. In accordance with the French Data Protection Act of 6 January 1978, the Client has the right to access, modify, rectify, and delete personal data concerning them. If the Client wishes to exercise this right, they simply need to write to FERME DU CHATEAU, Impasse du Château, 76550 Ambrumesnil, France, stating their name, surname, and address. FERME DU CHATEAU reserves the right to collect data on the Client through the use of cookies in order to improve the personalised service offered to the user.
13. Liability
FERME DU CHATEAU cannot be held liable for any inconvenience or damage related to the use of the Internet, such as service interruption, the presence of computer viruses or external intrusions, or more generally any cases qualified as force majeure by the courts.
14. Miscellaneous Provisions
The invalidity or unenforceability of any of the clauses in these general terms and conditions of sale or in the special conditions will not affect the application or validity of the other clauses. Such a clause will then be replaced by the closest possible provision. Neither FERME DU CHATEAU nor the Client can be held liable for non-performance of the contract due to force majeure, including but not limited to war, riot, insurrection, interruption of transport, import problems, strike, shortage, fire, earthquake, storm, or flood.
